TERMS, PRIVACY
& LICENCE.

Effective 23 July 2026. These working terms apply to website-template source files, guides and related digital products sold by Foldstate through foldstate.co.za or Whop.

Required before accepting payment: add the legal operator's full registered or personal name, legal status, physical and service address, telephone number, support email and any applicable registration and VAT details. Confirm the final checkout, refund process and licence with a South African attorney. This operational draft is not legal advice.

1. Product and payment

What is supplied

The product is the downloadable website source, structured brand and content files, documentation and other items specifically listed on the relevant checkout page. A preview, social post or product image does not add a feature that is not included in that list.

Compatibility

“Model-neutral” means the instructions use ordinary project files and are designed for coding assistants capable of reading them. Foldstate does not guarantee compatibility with every tool, model, subscription tier, host, browser extension or future software version. The buyer remains responsible for reviewing AI-generated changes before publication.

Price and fulfilment

Prices are once-off unless checkout clearly states otherwise. Whop processes payment, tax presentation, receipts and file delivery under its own terms. Foldstate does not receive or store complete payment-card details. The product, price, currency, licence count and support period shown at checkout govern that order.

2. Template licence

Permitted use

Each purchased licence grants the buyer a non-exclusive, non-transferable right to use the selected kit to create one finished public website for the buyer or one named client. The finished website may be commercially operated and its public text, colours, imagery, layout and code may be modified.

Additional projects

A separate licence is required for each additional end project, client, domain or materially separate business, unless the checkout expressly grants a broader licence. Staging, development and backup copies for the same licensed project do not require another licence.

Prohibited use

The buyer may not resell, sublicense, share, publish or distribute the source files as a template, starter, theme, component library, course download, repository or competing product. The buyer may not remove ownership notices from the documentation, use the kit to train a model, or make the original source available for extraction by unrelated third parties.

Third-party material

Only material expressly included in the download is licensed. Fonts, photographs, logos, plugins, APIs, AI tools, hosting and other third-party services may have separate licences or charges. Preview content must be replaced where the documentation marks it as demonstration-only.

3. Cancellations, defects and refunds

Nothing in these terms excludes or limits a right or remedy that cannot lawfully be excluded under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable law.

Digital delivery

Because access to source files is normally supplied immediately, the buyer should inspect the product description and compatibility notes before purchase. Any statutory cooling-off right that applies to the transaction remains available according to the law; these terms do not ask a consumer to waive a non-waivable right.

Defective or misdescribed files

If the download is inaccessible, corrupt or materially different from the checkout description, notify Foldstate promptly with the order reference and enough detail to investigate. Foldstate may first repair, replace or redeliver the affected file within a reasonable time. If that cannot reasonably be done, an appropriate refund or price reduction will be considered subject to applicable law.

Change of mind

Outside mandatory rights, a correctly delivered digital product is not refundable merely because the buyer changed direction, lacks a compatible coding tool, prefers another style or expected a business outcome that was never promised.

4. Privacy notice

Foldstate processes personal information in accordance with applicable South African privacy law, including POPIA. This static website does not contain a Foldstate account system or marketing signup form.

Information that may be processed

  • Order, identity, contact and billing records supplied through Whop.
  • Support messages, attachments and project details voluntarily sent by the buyer.
  • Essential security, request, device and hosting logs generated by service providers.

Purpose, sharing and retention

Information is used to fulfil orders, provide support, prevent abuse, keep records and meet legal obligations. It may be shared with Whop, Netlify, professional advisers and other necessary service providers, or where legally required. Foldstate does not sell personal information. Records are retained only for reasonable operational, security, contractual and legal periods.

Your choices

A data subject may request access or correction, ask for deletion where applicable, object to certain processing and lodge a complaint with South Africa's Information Regulator. A working privacy and support email must be published before paid launch.

5. Outcomes, availability and liability

No outcome guarantee

Foldstate does not guarantee sales, traffic, conversion rate, search ranking, social reach, brand approval, legal compliance or a specific result from an AI system. Examples and previews demonstrate possible presentation, not expected earnings.

Buyer responsibility

The buyer is responsible for final copy, claims, images, accessibility, privacy notices, cookie controls, consumer disclosures, security, integrations, deployment and compliance relevant to the finished website. The buyer must review generated code and keep appropriate backups before changing or publishing it.

Third-party services

Whop, Netlify, domain registrars, coding assistants and other platforms are independent services governed by their own terms. Foldstate is not responsible for their outages, prices, model behaviour, policy changes, account decisions or data practices.

Liability boundary

To the maximum extent permitted by law, Foldstate is not liable for indirect or consequential loss, lost profit, lost data, business interruption, third-party claims or AI-generated changes. Aggregate liability for a claim is limited to the amount paid for the affected product. This limitation does not apply where liability cannot lawfully be limited, or to fraud, wilful misconduct or gross negligence.

Law and changes

South African law governs the agreement. The version presented at purchase applies to that order. Material changes will not retroactively reduce an existing buyer's purchased licence.
